Terms of Service

Welcome to AakrutiAI. AakrutiAI is a product operated by Shreenath TechCons("Shreenath TechCons", "we", "us", or "our"). These Terms of Service ("Terms") constitute a legally binding agreement between you ("User", "you") and Shreenath TechCons. By accessing or using AakrutiAI (the "Service") you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 18 years old and able to form a legally binding contract under Indian law to use AakrutiAI.

2. Your Account

• You must provide accurate, current information when signing up.
• You are responsible for maintaining the confidentiality of your credentials and for all activity under your account.
• Notify us immediately at support@aakrutiai.com of any unauthorised access.

3. Subscriptions, Credits & Billing

• Paid plans are billed in advance on a monthly or annual basis (as selected at checkout).
• Thumbnail generation consumes credits. Unused credits do not roll over to the next billing period unless your plan specifies otherwise.
• All fees are in INR unless stated otherwise and inclusive of applicable GST.
• Payments are processed by Easebuzz. We do not store full payment instrument details.

4. Refunds & Cancellation

Refund and cancellation terms are described in our Refund & Cancellation Policy. That policy is incorporated into these Terms by reference.

5. Acceptable Use

You agree not to use the Service to:

• Generate content that is unlawful, obscene, defamatory, hateful, inciting violence, or infringing others' rights.
• Upload images of people without their consent, or impersonate any person.
• Create misleading content (e.g. deepfakes of real people designed to deceive).
• Reverse engineer, scrape, or resell the Service or its outputs as a competing AI service.
• Attempt to bypass rate limits, credit limits, or security.
• Use the Service in violation of any applicable law.

We may suspend or terminate accounts that violate these rules, without refund.

6. Your Content

You retain all rights to images and inputs you upload ("User Content"). By uploading, you grant AakrutiAI a limited, non-exclusive, worldwide, royalty-free licence to host, process, transmit to AI providers, and display your User Content solely to provide the Service to you.

You represent that you own or have all necessary rights to your User Content and that it does not violate these Terms or any third-party rights.

7. Generated Output

Subject to compliance with these Terms and our AI providers' terms, you own the thumbnails you generate and may use them for any lawful purpose, including commercial use. You acknowledge that AI outputs may be similar for different users and are not guaranteed to be unique or copyrightable.

8. Third-Party Services

The Service uses Google Gemini, Replicate, Supabase, Resend, Vercel, and Easebuzz. Their respective terms and privacy policies apply to the data processed by them on our behalf.

9. Intellectual Property

The Service, including software, design, logos, templates, and brand assets, is owned by AakrutiAI and protected by copyright, trademark, and other laws. You are granted a limited, non-transferable, non-exclusive licence to use the Service as intended.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT GENERATED OUTPUTS WILL MEET YOUR REQUIREMENTS.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, AAKRUTIAI'S AGGREGATE LIABILITY FOR ANY CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM. WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.

12. Indemnification

You agree to indemnify and hold harmless AakrutiAI and its affiliates, officers, and employees from any claim, demand, or damages arising out of your User Content, your breach of these Terms, or your misuse of the Service.

13. Termination

You may cancel your account at any time from the Settings page. We may suspend or terminate your access immediately for violations of these Terms. Upon termination, your licence to use the Service ends; data will be handled per our Privacy Policy.

14. Governing Law & Jurisdiction

These Terms are governed by the laws of India. The courts at Bengaluru, Karnataka have exclusive jurisdiction for any disputes, except where applicable consumer-protection laws give you rights in your local jurisdiction.

15. Changes

We may update these Terms. Material changes will be notified by email or in-app notice at least 7 days before they take effect. Continued use of the Service after changes constitutes acceptance.
